Reinstatement

OUT-OF-STATUS
Failure to maintain status can happen either by dropping under 12 credit hours, working off campus illegally or not beginning classes by the date indicated on the I-20. There is the option of reinstating F-1 visa status in the United States. If you have been out-of-status for longer than 5 months, you are ineligible for reinstatement. MCC is required to report to United States Citizenship and Immigration Services (USCIS) within 21 days when a student drops below 12 credits. Make an appointment with an International Student Advisor to determine eligibility for reinstatement. If you qualify, complete the following process:

REINSTATEMENT PROCESS:
Submit the following documents to the Admissions Office:

1.

Write a letter to USCIS explaining the reason(s) you have fallen out-of-status. Specifically, the reasons for the status violation; the effect on failure to receive reinstatement; a statement that you are currently pursuing or are intending to pursue a full course of study; and specifically request that USCIS reinstates you to F-1 status.

2. Obtain a new financial guarantee letter of support.
3. The original SEVIS I-20.
4. I-94 (small white card in your passport).
5.

Complete an I-539 form (from Admissions Office or print from USCIS website at: http://uscis.gov/graphics/formsfee/forms/i-539.htm
Write in Part 2, item 1 “reinstatement to F-1 status”

6. A check payable to “USCIS” for $195.00


RECOMMENDED: Attach a copy of school schedule/invoice showing you’ve paid tuition.
**As of early 2002, denials of reinstatements have increase dramatically. Students are encourage to maintain status to the best of their ability. Always consult with an advisor before withdrawing classes below 12 credits.
